Assault and Battery

Generally speaking an assault occurs when an action or a threat places someone in imminent fear of bodily injury or death. Battery occurs when there is a physical touching of the victim. Some defenses to these crimes are self-defense, defense of others and defense of property. I have defended clients charged with a variety of assault and battery charges including:

  • Aggravated assault with a deadly weapon
  • Assault
  • Aggravated battery with a deadly weapon
  • Domestic violence
  • Disorderly conduct
  • Battery

If a deadly weapon is involved, there are mandatory guidelines that a court will follow when sentencing you on an assault and battery charge.  I have extensive experience helping clients understand the guidelines and how these guidelines will affect their case.

Often times, domestic violence charges result because a police officer has failed to use his discretion. As a result, family conflicts can turn into criminal charges. Ultimately, it is the prosecutor or State Attorney who charges the crime. I will do everything I can within the letter of the law to prevent charges from being filed. If charges do get filed, I will work hard to get them dismissed.
